Welcome to Bitbook. These Terms of Use ("Terms") govern your access to and use of the Bitbook website, applications, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. Children under 13 may use the Service only through a parent's account and at the parent's discretion.
You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us right away if you believe your account has been compromised.
All books and content created, uploaded, or shared on Bitbook must be family-friendly. Bitbook is a place where children may read, look at, and participate in stories. Anything that wouldn't be appropriate in a general-audience children's bookstore isn't appropriate here.
You agree not to create, upload, generate, share, or distribute content that:
• depicts or describes sexual activity, nudity, or sexually suggestive material;
• glorifies or graphically depicts violence, gore, abuse, cruelty, or self-harm;
• promotes hate, harassment, or discrimination against any group or individual based on race, ethnicity, religion, national origin, gender, sexual orientation, disability, or other protected characteristics;
• depicts the use of drugs, alcohol, tobacco, or other controlled substances in a way that promotes their use, particularly to minors;
• contains profanity, slurs, or crude language inappropriate for a general audience of children and families;
• sexualizes or endangers minors in any way (this is a permanent, no-exception rule);
• contains real personal information about children other than your own, or about anyone without their consent;
• is intended to harass, bully, threaten, or intimidate another person; or
• is illegal, infringes someone else's rights, or violates any applicable law.
We may remove any content that violates these standards at our discretion, with or without notice. We may suspend or terminate accounts that repeatedly or seriously violate the family-friendly rule. We are not obligated to publish or continue hosting any particular content.
You keep ownership of the stories, illustrations, characters, text, and other content you create with the Service ("Your Content"). To run the Service — to display Your Content in the app, to print physical copies, to deliver shared books to people you publish or sell to, and to back up and operate the platform — you grant Bitbook a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (only for formatting and rendering), display, and distribute Your Content on the Service.
If you publish or sell Your Content through Bitbook, that license extends to allow purchasers and the public to view your published work as described in the relevant product flow. You can unpublish or delete Your Content at any time; we'll stop displaying it going forward, though copies may remain in backups for a reasonable retention period.
You promise that you have the right to upload everything you upload — that you own it, or have permission, and that it doesn't infringe anyone else's copyright, trademark, privacy, publicity, or other rights.
The Service uses third-party AI models to help you generate text and illustrations. AI output can be inaccurate, biased, or unexpected. You are responsible for reviewing what you create before publishing or sharing it. The family-friendly and ownership rules above apply to AI-generated content the same way they apply to anything else.
In addition to the family-friendly content rule, you agree not to misuse the Service. Don't try to break, overload, or probe the Service for vulnerabilities; don't reverse-engineer or scrape the Service or use it to train AI models without our consent; don't impersonate other users or pretend to be affiliated with Bitbook when you aren't; don't use the Service to send spam, malware, or unsolicited promotional material; and don't use the Service in violation of any applicable law.
Some features (such as additional credits, premium subscriptions, and printed copies of books) require payment. Prices are shown in the app at the time of purchase. Payments are processed by third-party providers (currently Stripe). All sales are final unless otherwise stated, except where required by law.
For physical books, manufacturing and shipping is handled by a print-on-demand partner. Once production has started we generally cannot cancel or refund an order, but we'll work with you in good faith if a printed book arrives damaged or defective. Subscriptions renew automatically until cancelled. You can cancel anytime in your account settings; cancellation takes effect at the end of your current billing period.
If you list your book for sale or run a storefront on Bitbook, you keep ownership of your work and we take a platform share described in the storefront flow. You agree that everything you list complies with these Terms (including the family-friendly rule) and any tax obligations you owe on earnings from sales are your responsibility.
The Service itself — its software, design, branding, and the tools we provide — belongs to Bitbook and our licensors. We grant you a limited, non-transferable, revocable license to use the Service while these Terms are in effect. We don't claim ownership of your stories or illustrations beyond the license described in section 3.
You can stop using the Service at any time and delete your account from your account settings. We may suspend or terminate your access if we reasonably believe you have violated these Terms — particularly the family-friendly content rule — or if doing so is necessary to protect the Service or other users. Sections that by their nature should survive (ownership, indemnity, disclaimers, governing law) survive termination.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that any AI-generated content will be accurate or appropriate for your specific use.
To the fullest extent permitted by law, Bitbook will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim related to the Service is limited to the greater of (a) the amounts you paid Bitbook in the twelve months before the claim arose or (b) one hundred US dollars.
You agree to defend and indemnify Bitbook against claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms — particularly claims that your content infringes someone else's rights or violates the family-friendly content rule.
We may update these Terms from time to time. If we make a material change, we'll let you know in the app or by email before the change takes effect. By continuing to use the Service after a change, you accept the updated Terms.
These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
